Terms of Service

1. About Us

This website is operated by Warm Energy Labs Ltd trading as Fan Coil (also referred to as “Heat Pump Fan Coil”).

2. Placing an Order

By placing an order on fancoil.co.uk, you agree to these terms. An order is a request to purchase — it becomes a binding contract when we confirm dispatch of the goods.

You must create an account to place an order. You are responsible for maintaining the security of your account credentials.

All prices are shown in GBP. Prices are displayed ex-VAT and inc-VAT depending on your VAT display preference. VAT at the prevailing rate (currently 20%) is applied to all orders.

3. Payment

Payment is by bank transfer only. An invoice will be sent to your registered email address after you place your order.

Payment is due on receipt of the invoice. No products will be allocated or dispatched until payment has been received and cleared in our bank account.

We reserve the right to cancel any unpaid order. If an order is cancelled due to non-payment, any stock allocated to that order will be released.

4. Prices

We make every effort to ensure prices on the website are accurate. If we discover an error in the price of goods you have ordered, we will contact you to inform you of the correct price. You may then choose to proceed at the correct price or cancel the order for a full refund.

Prices may change at any time, but changes will not affect orders for which we have already sent an invoice.

5. Delivery

Delivery is by pallet to UK mainland addresses. A delivery charge of £80.00 + VAT applies to all orders. See our Shipping Policy for full details.

Delivery dates are estimates only. We are not liable for delays caused by events outside our control (carrier delays, weather, industrial action, etc.).

Risk in the goods passes to you on delivery. Title to the goods remains with us until payment has been received in full.

6. Cancellation and Returns

You have the right to cancel your order within 14 days of receiving the goods under the Consumer Contracts Regulations 2013. See our Returns Policy for conditions, restocking fees, and return shipping.

7. Warranty

All products are covered by our manufacturer’s warranty. The warranty terms, including the two-tier warranty structure (1-year standard, 3-year extended), are detailed in the product installation manual available at fancoil.co.uk/documents.

The warranty covers replacement parts only. Labour, access costs, and system drain-down costs are not covered. See the installation manual for full terms.

8. Limitation of Liability

Nothing in these terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded or limited under applicable law, including your statutory rights under the Consumer Rights Act 2015

Subject to the above, our total liability to you in respect of all losses arising under or in connection with the contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total amount paid by you for the goods under that order.

We are not liable for any indirect or consequential losses, including but not limited to loss of profit, loss of business, loss of earnings, or costs of alternative cooling or heating arrangements, to the extent permitted by law.

We are not liable for any damage caused by incorrect installation, failure to follow the installation manual, inadequate pipework insulation, or failure to maintain the equipment.

9. Your Statutory Rights

Nothing in these terms affects your statutory rights as a consumer under the Consumer Rights Act 2015. If goods are faulty, not as described, or not fit for purpose, you may be entitled to a repair, replacement, or refund.

10. Use of the Website

You may use this website for lawful purposes only. You must not misuse the website by introducing viruses, attempting to gain unauthorised access, or interfering with its operation.

We may update the website and these terms from time to time. The terms that apply to your order are those in force at the time you place the order.

11. Intellectual Property

All content on this website — including text, images, diagrams, logos, and software — is owned by Warm Energy Labs Ltd or its licensors and is protected by copyright. You may not reproduce, distribute, or commercially exploit any content without our written permission.

12. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these terms affects your rights as a consumer to rely on such mandatory provisions.
